Welcome to SnapMenu.in! Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the SnapMenu.in website (the "Service") operated by SnapMenu ("us", "we", or "our").

2. Acceptance of terms

By using our Service, you agree to these Terms. If you do not accept any part of the terms, you should not access the Service. These Terms apply to all current and future customers of SnapMenu, including those with access to a 'restaurant business page' for managing their claimed listings. Your use of the SnapMenu Platform is at your own risk, which includes potential exposure to content that may be offensive or unsuitable. To use the Services, you must agree to the Terms, either by clicking to accept them when prompted by SnapMenu or by using the Services, in which case your usage will be considered acceptance of the Terms from that moment forward.

3. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. The most current version of the Terms will be posted on the site with the "Last updated" date at the bottom. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

4. Use of Service

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Service.

5. User Retention Policy

At SnapMenu, we prioritize providing value and a seamless experience to our users while respecting their preferences and privacy. We may retain user data as necessary to fulfill the purposes outlined in our Terms of Service and Privacy Policy, such as improving services, analytics, and compliance with legal requirements. 7. User Accounts

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.

All content provided on SnapMenu.in, including but not limited to text, graphics, logos, images, and software, is the property of SnapMenu or its content suppliers and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the content without our prior written consent.

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of SnapMenu and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

10. Links to Other Websites

Our Service may contain links to third-party websites or services that are not owned or controlled by SnapMenu. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that SnapMenu shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

12. Limitation of Liability

In no event shall SnapMenu, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Service; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through our Service by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the Service; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delhi/India, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising under or in connection with these Terms shall be resolved through negotiations between the parties. If the dispute cannot be resolved through negotiations, it shall be settled by arbitration conducted in Delhi, India, in accordance with the applicable laws of Delhi/India. The arbitration shall be conducted according to the rules of arbitration in Delhi/India, without the involvement of a specific arbitration organization.

15. Changes to the Service

We reserve the right to withdraw or amend our Service, and any service or material we provide via the Service, in our sole discretion without notice. We will not be liable if, for any reason, all or any part of the Service is unavailable at any time or for any period.

16. Pricing

SnapMenu charges a service fee based on customer orders processed through our platform. Our pricing model is as follows:

1. a) We charge 2% of the order value or 1 rupee per customer order, whichever is higher.
2. b) This fee is applied to each order at the time of transaction and is non-refundable.
3. c) SnapMenu reserves the right to review and adjust our pricing structure periodically. Any changes to the pricing policy will be communicated via updates to these Terms and Conditions, and by continuing to use the Service, you accept the updated pricing policy.

17. Cancellation and Refund Policy

1. 1. If you cancel an order or provide incorrect details (like address or contact info) and it leads to cancellation, you breach your authorization for SnapMenu to place that order. In this case, you’ll owe liquidated damages equal to the order value, which SnapMenu may deduct from future payments.
2. 2. If SnapMenu cancels your order due to technical issues, item unavailability, or reasons not caused by you, there won’t be a cancellation charge. If payment was made, eligible refunds will be reversed to you.
3. 3. No refunds or replacements will be issued without the Restaurant Partner’s or Store’s approval.
4. 4. For complaints about your order (like food issues or wrong items), you must provide proof before any resolution is given.
5. 5. You won’t receive a refund if your specific instructions were not followed as intended, as they are followed on a best-efforts basis.
6. 6. Refunds will be processed according to how they were received, reflecting your bank's policies, unless provided as credits.
